2015: Bill of Hydrometeorology to be submitted to the Government

Law on Hydrometeorology is an important law, which determines the legal framework in accordance with the hydrometeorological practices, both domestic and worldwide, and is integrated into the issue of responding to climate change. As planned, in 2015, the hydrometeorological branch will focus on building the Hydrometeorological bill to be submitted to the government.


Current Law: not updated with realities


According to Mrs. Nguyen Thi Binh Minh, Deputy Director of the Department of Hydrometeorology and Climate Change, the formulation of the Law of Hydrometeorology is urgent, as the relevant existing legislation texts in this field is much dispersed and no longer suitable with realities, particularly in the context of climate change.


The text with highest legality referring to the field of activity in its fullness is the Ordinance of exploitation and protection of Hydrometeorology works, which has been in effect since 1994. To date, there are many shortcomings found in this ordinance.


The current legal texts regarding hydrometereology are mostly based on the technological level of hydrometeorology observation of the past 10 – 15 years, which mainly employed manual methods.


“In the context of global climate change being credited with increasing clear expressions, more intense natural disasters, legal provisions on Hydrometeorology are expected to have their scope expanded, and their contents associated with the prevention of natural disasters and climate change … “, said Ms. Minh.


Hydrometereology Law: Scope Expanded


The construction of Draft Law on Hydrometeorological was started in 2009. Bureau of Meteorology, Hydrology and Climate Change has translated and studied the Law of Hydrometereology of a number of countries and sovereign territories such as Russia, China, Taiwan and Australia. Legal experts also consulted foreign experts and studied the construction of law governing practices in the field of hydrometeorology in China, Hong Kong and the Philippines.


From the research activities and studies of practical works, experts have made a number of key points to be applied in building the Hydrometeorological Law. One point is hydrometeorological activities, which contribute to ensuring safety of lives and property of the people and society as well as security and defense should be overseen by a State agency.


The State Hydrometeorological Agency should have a key role in ensuring the provision of information to serve disaster prevention and national security, establishment of monitoring systems, data collection and primary forecasts. The State also encourages the industries, organizations and individuals to be involved in hydrometeorological activities, aimed at socializing hydrometeorological activities, so that they can meet diverse socio-economic requirements.


The scope of objects should also be expanded. The state needs to enforce a unified management of nationwide hydrometeorological activities, including such activities as hydrometeorological monitoring, collecting, adjusting, data storage, forecasting , supply products and the Hydrometeorological broadcast to all data used.


The State must set out the legal framework and guidelines for hydrometeorological infrastructure development policies, training and development of human resources and application to serve hydrometeorological development activities.


Experts have pointed out that, products of hydrometeorological activities should be clearly classified for the sake of proper observation. Accordingly, these products should be classified into two types : Type 1 – used in public service and disaster prevention should be provided free of charge and widely available; Type 2 -more specialized types are considered to a kind of goods in the society.


In the context of international integration and global climate change, the current law should reflect a willingness to carry out international exchange of hydrometeorological information and international cooperation in hydrometeorology, which are done on the basis of international agreements signed by Vietnam.
