The family of a boy who miraculously survived being torn from the womb in a traffic accident that killed his mother last year has decided not to take legal action against the driver.
“No one wanted that to happen. And I know the driver is very poor,” said 55-year-old Nguyen Van Khoanh of An Giang Province, the boy’s grandfather.
In Vietnam, judicial bodies can try those responsible for a death even when the victim’s relatives request no legal proceedings.
On Saturday, a court in the Mekong Delta province did exactly just that. It sentenced 40-year-old truck driver Do Cong Vu to two and a half years in jail for the fatal accident.
On October 25 last year, Vu, a driver of the Delta AGF Investment and Construction Company, was driving a concrete truck on the National Highway 1A.
At a section in the province’s Long Xuyen Town, he hit a motorbike from behind.
On that bike, Nguyen Van Nam was carrying his wife Nguyen Thi Kim Ngoc to a local hospital to give birth.
The wheels of the truck crushed Ngoc, killing her on the spot and forcing her baby out of the womb.
The boy survived miraculously but he and Nam both lost portions their legs in the accident. The child is the couple’s second child.
The tragic accidents made headlines and Samaritans donated the family a total of VND2.9 billion (US$135,700).
At the Saturday trial, Vu cried for most of the time and asked the victim’s family for forgiveness.
The family requested the court to be lenient. They even gave him VND10 million (US$470).
