Domestic workers not lower than basic salary

As the government’s decree on the Code of Labor in relation to domestic workers starting on May 25, those who employ domestic workers in Vietnam must not pay them less than applicable minimum wages.

The decree says that employers negotiate with their domestic workers on monthly salaries in a labor contract. Monthly salaries including accommodation expenses in the employers are not lower than the minimum wage applicable in the zone where they are working.

As per the decree, along with a monthly wage, employers ought to give their domestic workers an amount of money which is equal to money to pay for the social insurance and health insurance premiums stipulated in their labor contracts.

In addition, when domestic workers are sick, employers have to allow them stop working to go to hospitals for treatment and rest. Medical cost will be paid by domestic workers and employers don’t pay salary for days-off due to sickness.

Also under Decree 27, employers and domestic workers will deal on working hours and days off. Domestic workers are entitled to have eight off-hours in a day including six consecutive hours. Employees can have 24 consecutive off-hours a week or at least four days-off per month.

Moreover, they can take 12 paid days off for every full working year and receive full salary in these days off.

Currently, it is popular that people in urban district hire domestic workers. Average month salary of a domestic worker in Hanoi is around VND3-4 million a person excluding accommodation expenses but most of domestic workers don’t participate in social and health insurance.

Zone 1 covers the urban areas of Hanoi and Ho Chi Minh City while Zone 2 includes the rural regions of the two hubs along with the urban areas of Can Tho City, Da Nang City, and Hai Phong City. Zone 3 covers provincially-run cities and the districts of Bac Ninh, Bac Giang, Hai Duong, and Vinh Phuc Provinces. Zone 4 spans the remaining localities.
