Enterprises in Vietnam have commended the Ministry of Planning and Investment for issuing high-quality legal normative documents.

The MPI ranks number one in term of efficiency in making legal normative documents

The Vietnam Chamber of Commerce and Industry released its Ministerial Effectiveness Index 2014 (MEI 2014) last week, which assessed the performance of 14 ministries in 2014 based on survey responses from 228 business associations representing 409,591 enterprises nationwide.

Providing an overall picture on ministries’ efforts and shortcomings in business law development and implementation, MEI 2014 evaluated the ministries across five categories, namely “efficiency in making legal normative documents (LND)”, “LND quality”, “efficiency in disseminating legal information”, “efficiency of law implementation”, and “review, inspection, and summarising legal implementation”.

Regarding the ranking of “efficiency in making LND”, the Ministry of Planning and Investment (MPI) ranked first (58 per cent), followed by the Ministry of Justice (56 per cent), and the Ministry of Agriculture and Rural Development – MARD (53 per cent).

The index on LND quality assesses transparency, consistency, feasibility, and reasonability. The MARD scored the highest with 66 per cent, followed by the MPI with 64.8 per cent, up 8.61 per cent against the previous MEI in 2012. The Ministry of Transport (MoT) was practically neck-and-neck with the MPI, scoring 64.6 per cent. Meanwhile, bringing up the rear was the Ministry of Labour, Invalids and Social Affairs (MoLISA) with 64.2 per cent, and the State Bank with 63 per cent.

“Businesses have applauded the great efforts of the MPI in drafting especially important legal documents for enterprises, such as the amended Investment and Enterprises laws in 2014,” said VCCI chairman Vu Tien Loc.

“These laws, due to take effect from July 1, 2015, have attracted a lot of attention from enterprises as they embrace new regulations on creating more favourable conditions for enterprises. For example, the laws respect enterprises’ freedom to conduct business, through transparent procedures for business sectors,” Loc said.

Under the Law on Investment, the number of banned business sectors has been slashed from 51 to just six. Additionally, the number of business sectors subject to conditions has also dropped from 386 to 267.

In all of the remaining categories, the MPI scored highly and made significant improvements from the previous MEI in 2012.

On average, the MPI has recorded a 7.27 per cent rise in its MEI score for 2014, as compared to MEI 2012.

The assessed ministries include Industry and Trade, Natural Resources and Environment, MoT; Information and Communications, MPI, Justice, Science and Technology, Ministry of Culture, Sport and Tourism, MoLISA, Construction, MARD, Health, Finance, and the State Bank.
